Kevi Application User Agreement

1. Acceptance of Terms

By downloading, installing, or using the Kevi application ("App"), you ("User") agree to be bound by this User Agreement ("Agreement"). This Agreement constitutes a legal contract between you and the developer of Kevi ("Developer"). If you do not agree to all terms of this Agreement, you must not use the App.

2. License to Use the App

Subject to your compliance with this Agreement, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App on iOS devices solely for your personal, non-commercial purposes. This license does not include: (a) any resale or commercial use of the App; (b) modification or derivative works of the App; (c) distribution of the App; or (d) access to the App for purposes of building a similar or competitive product.

3. User Responsibilities

You agree to use the App in compliance with all applicable laws, regulations, and this Agreement. You shall not:

• Use the App to upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, or infringing on third-party rights;
• Attempt to reverse engineer, decompile, or disassemble any part of the App;
• Use the App to violate the privacy or intellectual property rights of others;
• Use the App in any manner that could damage, disable, or impair the App's functionality;
• Share your account credentials or allow unauthorized third parties to access the App through your account.

4. Intellectual Property Rights

All content within the App, including but not limited to templates, designs, graphics, text, and software, is the exclusive property of the Developer or its licensors and is protected by United States copyright, trademark, and other intellectual property laws. The pomegranate red color scheme and Christmas-themed elements are proprietary to the App's design. You may download and use templates for personal purposes only, but you shall not claim ownership or redistribute them commercially.

5. Privacy

Your use of the App is subject to the Developer's Privacy Policy, which governs the collection, use, and disclosure of your personal information. By using the App, you consent to such collection and use.

6. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The Developer does not warrant that the App will be error-free, uninterrupted, or free from viruses or other harmful components.

7. Limitation of Liability

To the maximum extent permitted by law, the Developer shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your use or inability to use the App, even if advised of the possibility of such damages. In no event shall the Developer's total liability exceed $50.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law principles. Any disputes arising out of this Agreement shall be subject to the exclusive jurisdiction of the courts located in the United States.

9. Modifications to Agreement

The Developer reserves the right to modify this Agreement at any time. Modified terms will be posted within the App, and your continued use of the App after such modifications constitutes acceptance of the new terms.

10. Termination

The Developer may terminate this Agreement and your access to the App at any time if you violate any terms of this Agreement. Upon termination, you must cease all use of the App and delete all copies of the App from your devices.
